We want you to know the facts about car rental protection and how to avoid significant financial repercussions in the event of an accident. Here are answers to some frequently asked questions about optional Hertz protection plans.

    Optional Hertz protection plans

    Supplement to liability insurance*

    Liability Insurance Supplement (LIS) gives you up to $1 million in increased protection if people injured in an accident make claims for personal injury and property damage. LIS will protect your insurance policy and/or personal property for the first $1 million if such claims are made against you. LIS also provides uninsured/underinsured motorists up to $1,000,000 per claim for combined personal injury and/or property damage claims.

    To the extent permitted by law, there is no liability protection under the terms of the rental agreement for claims for damages by third parties against you as a result of an accident with the rental vehicle. Some locations offer primary protection as part of the rental agreement. However, in the situations where protection is afforded by Hertz, such protection generally does not exceed the minimum limits required by state law. (See chart for these financial responsibility limits). For these reasons, some people feel more comfortable traveling with additional liability coverage. That's why Hertz is making the Liability Insurance Supplement (LIS) option available to you. Here are some facts you should know:

    • LIS provides you and other authorized operators of your rental vehicle with coverage for third party liability claims.
    • • LIS is the primary protection of your personal policy and provides the first $1,000,000** of coverage for combined personal injury and/or property damage claims per event in all states except California and Florida where coverage is $2,000,000.
    • LIS also offers uninsured and underinsured personal injury motorist coverage up to $1,000,000 per accident.

    *LIS includes liability insurance issued by ACE American Insurance Company.
    ** Represents a combined total of the state border where the accident occurred plus LIS.


    Does LIS coverage apply everywhere?

    You and authorized drivers are covered while driving the rental vehicle in the United States and Canada, but only if the vehicle is rented in the United States. The insurance cover is not valid in Mexico.


    Does my personal policy offer liability protection?

    You may not need the car insurance that Hertz offers. Your private car insurance may cover your liability while operating a rental vehicle. Motor vehicle liability insurance is not a condition for renting a vehicle.

    The conditions of the different car and umbrella policies are very different. Because LIS may provide duplication of coverage already provided by your personal policy, it is recommended that you review your policy or consult your insurance agent or insurer. However, keep in mind that in most cases, before your own policy coverage will be applied to a claim, the protection provided in the Rental Agreement and LIS, if you accept it, would first have to be exhausted. Keep in mind that claims against your personal policy can often result in premium increases or even cancellation.


    What about credit card coverage?

    We recommend that you find out about the type and scope of the cover offered. Credit card insurance may not cover liability claims or may be supplementary and only reimburse you for amounts not covered by other insurance.


    What happens if I damage someone else's property with a Hertz rental car?

    The Third Party Liability Supplement provides primary coverage for third party liability claims up to a limit of $1 million per accident.


    exclusions

    There are some exclusions from this coverage that we think you should be aware of. Under LIS you are not covered for liability in the event of an accident:

    • If LIS is not accepted at the start of the rental or if you fail to pay the charges for LIS.
    • If you or an Authorized Driver operated the Rental Vehicle in violation of the Rental Agreement.Including but not limited to operating the car while legally intoxicated or under the influence of alcohol, drugs or any other absorbed element.
    • If Auto or LIS coverage was purchased through fraud or misrepresentation. LIS is liability insurance only.
    • Except as permitted by law, LIS does not cover personal injury to you or an authorized operator of the rental vehicle, or to your or their family members related by blood, marriage or adoption living in your or their household.

    How to submit a LIS claim

    LIS coverage is automatically linked to the claim once you have properly reported the accident as per the Rental Agreement.


    Limits of financial responsibility by state

    The table below lists the limits of financial responsibility for automobiles in different states. Hertz is not required to provide such minimum protections in all states. However, purchasing LIS includes primary protection that combines these minimum protection limits with excess insurance to provide the first $1,000,000 of combined personal injury and/or property damage for each event.

    Limited Loss Damage Waiver (LLDW)

    Limited Loss Damage Waiver (LLDW) is offered at select locations. If you purchase an LLDW that is not insurance, you will not be liable for loss of or damage to the Hertz car up to a maximum excess of $1,000 unless the loss or damage resulted from prohibited use of the car is. You are responsible for all damages over $1,000.

    Comprehensive insurance (LDW)

    If you purchase Loss Damage Waiver (LDW), which is not insurance, you will not be liable for any damage to the Hertz vehicle should damage occur, provided the loss or damage is not due to a prohibited use attributed the car.

    What is your responsibility?

    In most states, when you rent a car from Hertz, you are responsible for all loss or damage to the car resulting from any cause, including but not limited to collision, rollover, theft, vandalism, impoundment, fire, flood, Hail or other natural events or force majeure, regardless of fault.

    In most states, your financial responsibility in the event of loss of or damage to the car, regardless of fault, extends to the full value of the car at the time of rental, less its residual value, plus the cost of towing, storage and impound fees, depreciation of the vehicle as determined by Hertz, an administration fee and a reasonable loss of use fee. If your responsibilities differ in the state where you rent, this will be stated in paragraph 4 of the rental agreement. In California and Nevada, your liability for loss of or damage to the vehicle from vandalism unrelated to theft does not exceed $500 and you are not responsible for theft, regardless of whether you purchased LDW, unless the theft results from your fault. In Illinois, your liability for loss or damage related to theft is limited to $2,000 unless the theft is at your fault.


    What protection does LDW offer?

    By accepting LDW, you are relieved of any financial responsibility for loss of or damage to the rental vehicle, whether or not you have insurance to cover such damage. In order for LDW to apply to claims for damages, you must properly report the applicable incident as per the rental agreement.

    However, if the Vehicle is obtained by fraud or you suffer an accident resulting from use of the Vehicle in a manner prohibited by Section 5 of the Rental Agreement, the LDW will be void and you will be responsible for any loss or damage to the Vehicle.


    Does my own car insurance cover damage to the rental car?

    This is the question we get asked the most. The answer depends on the state you live in and the type of policy you have. Each policy should be checked thoroughly for specific rental vehicle terms and conditions. You may have adequate coverage under your own automobile policy. However, in the event of a claim involving a rental car, you may be responsible for a deductible and possibly suffer premium increases or even cancellation of the policy. If you are unsure of the extent of your insurance coverage, ask your insurance agent or your insurer.


    What happens if damage occurs to a Hertz rental car during my rental period?

    Many of our customers are concerned about the cost of damaging their Hertz car during the rental. Hertz knows that accidents can happen, whether it's a collision, a natural phenomenon or damage that occurs outside the vehicle. You can rest assured that you are insured.

    We offer full comprehensive insurance so you don't have to worry or worry when driving our vehicles. LDW is not insurance, but it can protect you against the cost of damage to a Hertz car. By purchasing the LDW, you will not be liable for any loss or damage caused to the car as long as you have not used the car in a prohibited manner. However, without LDW, you are responsible for any loss or damage to the vehicle, including but not limited to theft, vandalism, collision, fire and natural disasters, regardless of fault.


    Hertz and your insurer

    Should you choose to rely on your own insurance, in the event of damage to the rental vehicle, Hertz will work with your insurer to reach an agreement. However, you are still responsible for any balance or damage that your insurer fails to pay.


    What about credit card coverage?

    As with any policy, you should carefully check the level of coverage with the card issuer. Remember that most credit card insurance policies are supplemental, meaning they will only reimburse you for loss or damage in excess of what your other insurance will cover and will not cover you for damage, regardless of the cause, if you accept LDW.


    Should you accept LDW?

    Only you can make that choice. By accepting LDW, you are relieved of any financial responsibility in the event of loss or damage to the rental vehicle. It also eliminates the worry of policy limits and extended costs often associated with filing a claim with your own carrier. Hertz offers comprehensive insurance as an option to protect you when you need it. However, the choice is entirely yours.


    Partial Waiver of Liability (PDW)

    In most states, when you rent a car from Hertz, you are responsible for any loss or damage to the car, regardless of fault. By accepting partial damage liability insurance (PDW), available in select locations, Hertz will not hold you liable for damage to the vehicle up to the applicable excess of your personal automobile insurance, up to a maximum excess of $1,000. For PDW to apply, you must properly report the accident in accordance with the terms of the rental agreement.

    Personal Accident Insurance (PAI)†

    To make your travel easier, Hertz provides you with a comprehensive insurance coverage package that includes accidental accident insurance as well as coverage for personal effects. The respective advantages of PAI and PEC are described below. Please note that PAI and PEC are not sold separately and must be taken in combination.

    Personal Accident Insurance allows you to choose accidental death and accidental health insurance for you and your passengers during the rental period of the vehicle.

    *Benefits mentioned in this summary do not apply to vehicles rented in New York State. In New York, the medical expense cap is $3,500 for the renter and each passenger. Ambulance cost cap is $150 for the renter and each passenger**.
    ** Passengers are defined as any additional occupants, including additional authorized operators of the Hertz vehicle.

    Total benefits for a single accident are limited to $225,000 and are paid in addition to any other coverage to which you or your passengers are entitled. However, your benefits provided by other coverage may be affected by the PAI benefits. The $225,000 single accident limit does not apply to Mississippi rentals.


    Accidental Death Benefit

    In the event of an accidental death independent of all other causes of death that occurs during the rental period of the vehicle, we will provide benefits in accordance with the schedule of services.


    Accidental Medical Expenses and Ambulance Allowance

    We will provide services in accordance with the Schedule of Services for reasonable and customary costs related to hospitalization; treatment by a doctor; Transportation to or from a hospital by a professional ambulance; and/or services provided by a registered nurse within 90 days of an accident and on the recommendation of a doctor.


    When are you insured?

    If this coverage is accepted, benefits will apply to you for all accidental injuries during your rental period, whether or not you are actually in the car. Your passengers are also covered, but only for incidents that occur while using the Hertz rental car. The first tenant to sign the lease is considered the tenant.


    What happens if I am injured in an accident while driving a Hertz rental car?

    Your safety is important to us. Personal Accident Insurance provides the renter with up to $2,500 coverage for accident-related medical expenses. PAI covers accidental medical expenses for treatment of injuries sustained while driving your Hertz rental vehicle and must be paid within 90 days. Additionally, in the event of your accidental death, PAI will provide up to $175,000 to your beneficiary.


    exclusions

    Benefits will not be paid for damage caused directly or indirectly by or charges for:


    • Deliberate self-inflicted harm, suicide or attempted suicide while you are mentally ill or sane;
    • air travel;
    • committing or attempting an assault or criminal offense;
    • An accident occurring under the influence of alcohol or narcotic drugs unless prescribed and taken on the advice of a physician**;
    • An accident occurring while participating in a prearranged or organized race or test of a vehicle;
    • war or any act of war;
    • engaging in illegal employment;
    • pregnancy or complications thereof or childbirth resulting therefrom;
    • Replacement glasses or eye exam, unless an injury causes visual impairment;
    • The insurance will not take effect if Renter is remodeling the Vehicle or during any period of time when the Insured Renter is in breach of the Rental Agreement. Renter will be deemed to have modified Vehicle if Vehicle is not returned to Owner by the Return Date or Extended Return Date. This is a summary only and other restrictions may apply. Please see the policy for additional exclusions, limitations and exceptions.

      **In Connecticut, the voluntary use of any controlled substance under Title II of the Comprehensive Drug Abuse Prevention & Control Act of 1970 unless directed by a physician.


    How to submit a PAI claim

    You canDownload the PAI application form hereor obtain a copy at any Hertz rental desk and mail it along with a copy of the rental agreement to: Hertz Claim Management Corporation P.O. PO Box 716 Park Ridge, NJ 07656.

    Claims must be made to the above address within twenty (20)*** days of the date of loss.

    ***In Mississippi, 30 days from the date of loss.

    Personal Items Coverage (PEC)†

    What PEC covers

    PEC is a risk of loss or damage option to protect your personal property while renting from Hertz. If you choose PEC, you are insured for the entire rental period. PEC is insurance coverage and pays in addition to any other policies you may have (e.g. a homeowners policy). However, your benefits provided by other coverage may be affected by the PEC benefit. PEC coverage covers personal belongings belonging to you and members of your immediate family traveling with you and permanent residents of your household during the rental period. PEC does not apply to non-family members traveling with you.

    † Insurance that covers personal items for an additional daily fee. Just one similar coverage per rental.

    coverage limits

    • Up to $600 per person, with maximum coverage capped at $1,800* for all claims during a rental.
    • In the event that claims are made under the policy, coverage for subsequent claims during the same rental will be reduced by the amount of the claim paid.

    * Benefits mentioned in this summary do not apply to vehicles rented in New York State. In New York, the limit of coverage is $500 per person, with maximum coverage for all claims during a rental limited to $1,500. Rentals originating in the state of Mississippi are not subject to the $1,800 per rental limit.


    exclusions

    Personal items not covered for loss or damage include:

    • Motor vehicles and their equipment, motorcycles, boats, engines or other means of transport or their accessories;
    • household furniture, currency, coins, stamps, deeds, securities, bars, tickets or documents;
    • CB radios, radar detectors, GPS devices, weapons, merchandise or works of art;
    • contact lenses, artificial teeth and limbs;
    • Perishable goods or animals.

    PEC does not cover losses from mysterious disappearances, nor:

    • Loss or damage caused by wear and tear, gradual deterioration, moth, vermin, inherent vices, or damage arising out of any process or during actual processing and damage resulting therefrom, or during the care, custody or control of an ordinary carrier.
    • losses caused by war or other acts of war;
    • Transport of contraband or illegal trade;
    • loss by nuclear reaction, radiation or radioactive contamination;
    • Loss or damage caused by theft unless reported to the police.

    All losses due to theft must be reported to the appropriate law enforcement authorities, otherwise they will not be covered. Insurance cover is excluded if the renter violates the rental agreement.


    How to submit a PEC claim

    If you're involved in an accident with a Hertz car and declined the optional Hertz protection plans because you thought your credit card insurance would cover you, consider these facts:


    • You must pay for your rental with the card that provides coverage or the coverage will not apply.
    • Most cards only reimburse you for your deductible after your own insurance has paid.
    • Some cards won't pay unless you submit documented "you pay first" repair bills by a specified deadline.
    • Some do not cover rentals longer than a certain period of time.
    • Some do not cover certain vehicle types or classes, e.g. large sport utility vehicles or certain luxury cars.
    • Some only cover you if you purchase separate, additional rental car protection before each rental, or sign up in advance and pay an additional fee for each rental.
    • Some do not cover rentals on cards issued outside the US.
    • Credit card car rental coverage covers damage to the car, not liability claims against you from someone injured in an accident.

    Personal car insurance coverage

    And if you think your own auto insurance will cover you for damage to the Hertz car, consider these facts:


    • Insurance coverage varies by state in which it is issued.
    • Insurance coverage can also vary from insurer to insurer.
    • Your coverage may be limited to the value of your own car, not the one you rent or the limits of your property damage coverage.
    • Some policies don't cover rental cars, or only cover them if your car gets repaired.
    • If your insurance doesn't pay Hertz in full, you're still responsible for the rest.
    • Your insurance premium could be increased as a result of this claim.
    • Your insurance could be canceled if this claim puts you at too high a risk.

    Does my own insurance cover damage to the rental car?

    The answer to this question depends on your insurance policy and state. If you don't have car rental coverage, you may have to pay a deductible and your policy may change if an accident occurs. Hertz recommends speaking to your insurance agent about your own coverage. Your agent can give you a better understanding of your own coverage and whether you benefit from any of our coverage options.

    What should one do?

    If you have checked carefully with your own insurance agent or insurer and the credit card company you use to rent and are completely satisfied with the coverage offered, you may decline the optional Hertz protection plans. However, if you are unsure about your insurance coverage or have determined that you do not have adequate insurance, accepting the optional Hertz protection plan that suits your needs may be a good choice for you.

    Hertz offers Optional Services individually and in various protection packages that contain meaningful combinations of the Optional Services. In describing these services, we have tried to eliminate the confusing legal terms to give you a clearer understanding of the options available to you and to help you decide which ones, if any, you may need.

    *These optional services are available for an additional daily fee for each full or partial rental day for each selected optional service.

    How do I accept these options?

    If you have checked carefully with your own insurance agent or insurer and the credit card company you use to rent and are completely satisfied with the coverage offered, you may decline the optional Hertz protection plans. However, if you are unsure about your insurance coverage or have determined that you do not have adequate insurance, accepting the optional Hertz protection plan that suits your needs may be a good choice for you.
